Stocks up in midday trading as spending rises

NEW YORK (AP) ? Technology companies led the stock market higher Monday, pushing the Standard & Poor's 500 index back up to the record high it reached earlier this month.
A pair of strong economic reports also encouraged investors. Wages and spending rose in the U.S. last month, and pending home sales hit their highest level in three years.
Shortly after 12 p.m., the Dow Jones industrial average was up 85 points at 14,798, a gain of 0.6 percent. Microsoft and IBM were among the Dow's best performers, rising 2 percent each.
Big tech firms have slumped this month. Concerns about weak business spending and slower overseas sales have weighed on the industry, said Marty Leclerc, the managing partner of Barrack Yard Advisors, an investment firm in Bryn Mawr, Pa. Revenue misses from IBM and other big tech companies have highlighted the industry's vulnerability to the world economy.
"The areas of the stock market that haven't done as well rely on exports," Leclerc said. "Those stocks more dependent on the domestic economy have done the best."
Tech played catch-up on Monday. Information technology stocks rose the most of the 10 industry groups in the S&P, 1.5 percent. It's the only group that remains lower over the past year.
The S&P 500 index was up 11 points to 1,593, a gain of 0.7 percent. That matches its all-time closing high reached on April 11.
The Nasdaq composite rose 32 points at 3,311, a rise of 1 percent. Apple, the biggest stock in the index, rose 3.5 percent to $431.95.
The number of Americans who signed contracts to buy homes reached the highest level since April 2010, according to the National Association of Realtors. Back then, a tax credit for buying houses had lifted sales. Separately, the government reported that Americans' spending and income both edged up last month.
Moody's and Standard & Poor's parent company McGraw-Hill surged following news that the ratings agencies settled lawsuits dating back to the financial crisis that accused them of concealing risky investments. McGraw-Hill gained 6 percent to $54.80, while Moody's jumped 10 percent to $61.02, the biggest gain in the S&P 500.
Eaton Corp. gained 5 percent to $61.31 after reporting that its quarterly net income jumped, beating Wall Street's estimates. The results were helped by its acquisition of Cooper Industries, an electrical equipment supplier.
In the market for government bonds, the yield on the 10-year Treasury note slipped to 1.65 percent. That's down from 1.67 percent late Friday.

This may not seem out of place in a country in which you can play video games on a toilet and the national tourism ambassador is... Hello Kitty, but Japan has a crying baby competition, and it's a little weird.
The "Naki Sumo," contest consists of two sumo wrestlers holding up children who were born in the previous year, standing across a sumo wrestling ring from each other and trying to make their opponent's baby cry.
The event, which has been held annually for over 400 years, is meant as a prayer for the children's healthy growth.
And if the babies don't cry? The referee puts on a mask to scare them.

Egypt president, judges compromising on reform law
CAIRO (AP) ? The Egyptian president's office indicated Sunday a compromise has been reached with the judiciary to defuse an uproar over a proposed law that would have forced out thousands of the country's most senior judges.
Just three days earlier, the country's Islamist-led parliament pushed ahead with the disputed bill that would have lowered the retirement age for judges from 70 to 60. That would affect nearly a quarter of Egypt's 13,000 judges and prosecution officials.
The draft also would have barred the courts from reviewing or overturning presidential decrees issued by the president late last year, including his unilateral appointment of a new top prosecutor.
The crisis over the judiciary is a reflection of the deep polarization that has split the country over the rule of Morsi and his Muslim Brotherhood party. Morsi has been in a power struggle with the judiciary since his June election.
In an attempt to resolve the situation, Morsi met Sunday with five top judges. A statement from the president's office after the meeting said Morsi will launch a conference this week to work out a compromise with judges regarding laws that affect the judiciary.
"The president said he will personally adopt all the conclusions of the conference for proposals of bills in order to submit them to the legislative council," the statement said.
After the meeting, opponents of the proposed law canceled protests set for Monday.
The president's allies say the courts are filled with loyalists of the deposed regime of Hosni Mubarak. The opposition accuses Morsi's backers of calling for reform of the judiciary as a cover to install their own supporters.
A protest by opponents and supporters of the bill led to street clashes in the capital nine days ago, and thousands of judges met last week to demand international organizations investigate the crisis. The dispute also prompted the resignations of top aides and advisers to the presidency.
The announcement by the president's office effectively shelves the law that was under discussion by lawmakers. A new proposal for a judicial reform law will likely first be agreed upon by Morsi and judges, and then be sent to the parliament.
Morsi is also facing divisions within the country's battered police force.
Dozens of Egyptian police officers disobeyed orders Sunday and stormed a superior's office in the capital, shut down a security directorate in the north and went on strike in the south.
It was the year's third wave of strikes by police, who demand incentives like better wages, greater firepower and more benefits.
The police force has not recovered from the days of the 2011 uprising that deposed Mubarak. His police were a symbol of the regime's unchecked powers and abuses, and they were forced from the streets in the early stages of the revolt by angry protesters.
The Interior Ministry, which oversees police in Egypt, relies on low-ranking police to protect government buildings. Hundreds of policemen have been wounded this year and several have been killed in anti-government protests.
Dozens of low-ranking officers stormed the office of the deputy interior minister in charge of health care for police. His office is inside the main police hospital in Cairo's Nileside neighborhood of Agouza. They said promises of better health care have gone unfulfilled.
In the south, police at five stations in the province of Assuit went on strike, charging that the government did not fulfill any of their demands.
In the Nile Delta province of Kafr el-Sheikh, police locked the gate to the security division with chains, according to security officials and state media reports.
Strikes also spread north of Cairo to Sharqiya and the Suez Canal city of Ismailiya.
Some are also calling for the dismissal of Interior Minister Mohammed Ibrahim. The minister met with some of the protesting policemen Sunday.
Others are protesting alleged attempts by the powerful Muslim Brotherhood to try to control the force, a charge the Islamist group denies. For decades, Egypt's police aggressively targeted the Brotherhood, and Morsi himself was imprisoned under Mubarak.
There are concerns that a recent decision to purchase 100,000 new 9mm pistols for police could lead to an even greater use of excessive force against unarmed protesters and civilians.
Officer Mohammed Mustafa was among those who stormed the deputy minister's office in Cairo on Sunday. He told The Associated Press that the group ended its sit-in after superiors vowed to look into their demands.
Though his salary has increased by almost three-fold following the uprising, Mustafa said he still earns only $185 a month. After 15 years on the job, low-ranking officers receive just $2,000 in compensation when they retire.
"Morsi, before he was president, promised that he would solve the problems of the police force," he said. "We want action, not words."

Twitter Settles With PeopleBrowsr, Gives The Company Firehose Access Until The End Of The Year
The saga of PeopleBrowsr vs. Twitter appears to have come to a close, AllThingsD reports. Last November, PeopleBrowsr took Twitter to court after the company had informed them that they’d be losing access to its full firehose of data. This was a move happening with nearly all third-party developers, but PeopleBrowsr contested that its four-year long relationship with Twitter could not be cut off that easily. After a somewhat astonishing public back and forth between the two companies, it sounds like the terms of the out of court settlement will be that PeopleBrowsr keeps firehose data until the end of the year, at which time it will shift over to one of Twitter’s approved data partners, Gnip, Topsy or DataSift. A Twitter spokesperson issued the following statement to us: We?re pleased to have this matter dismissed with prejudice, and look forward to PeopleBrowsr?s transition by the end of the year off of the Firehose to join the ecosystem of developers utilizing Twitter data via our reseller partnerships. While it’s not a win, it is the close of a case that kicked up dust from developers, some seeing PeopleBrowsr as fighting for the “little guys” who were slowly losing the access to Twitter’s data that they once enjoyed. This was not the case though, as PeopleBrowsr’s products, namely Kred, rely on this data to function. Basically, it had been paying Twitter $1 million a year to keep their business going. That’s not little. There’s no word on what it will have to eventually pay someone like Gnip for the same access. A spokesperson from PeopleBrowsr says that it’s “business as usual” now. Indictment: Prison gang leader fathered 5 children with 4 guards

A Baltimore prisoner is said to have fathered five children with four different corrections officers while incarcerated, according to a recently unsealed federal racketeering indictment.
In addition, the Washington Post reports that 13 female corrections officers assisted imprisoned gang members in criminal enterprises including the trafficking of drugs, witness intimidation and money laundering. Guards also tipped off prisoners about upcoming cell searches.
Tavon White, allegedly of the Black Guerrilla Family gang, reportedly bragged about his position of power within the jail. In an intercepted phone call detailed in the indictment, White is alleged to have said, "I hold the highest seat you can get. So regardless of what anybody say, whatever I say is law. Like I am the law... My word is law..., so if I told any mother-******* body they had to do this, hit a police, do this, kill a mother-******, do anything, it got to get done. Period."
The indictment is as disturbing as it is astounding. In it, prosecutors detail the various sexual relationships White had with different prison guards. Two of the women had the name "Tavon" tattooed on their bodies (one woman got the tattoo on her neck, the other on her wrist). These sexual relations "cemented the business ties and the association of the corrections officers with the enterprise," prosecutors wrote in the indictment. The guards are said to have smuggled in cellphones and drugs to the prisoners.
One prison guard was given a diamond ring by a gang leader. Others were provided with cars to drive (including two Mercedes Benzes, a BMW and an Acura). Two of those cars were purchased by a prisoner using proceeds from the illegal enterprise, according to the indictment.
All told, 25 people were charged with racketeering and drug offenses. They include inmates, guards, and outside suppliers. The Washington Post reports that 20 of them were also charged in a money-laundering conspiracy. Defendants will face a maximum prison sentence of 20 years on the racketeering and drug charges.
"We are committed to ensuring that this activity does not happen again," said Baltimore State?s Attorney Gregg Bernstein in a press conference.
Gary D. Maynard, Maryland secretary of Public Safety & Correctional Services, said, "It becomes embarrassing for me when we expose ourselves and we participate in an investigation that?s going to show what?s going on in our jails that I am not proud of."

PST: Wambach sidelined with head injury
Two days ahead of their home opener in Rochester, Western New York announced Abby Wambach will miss Saturday?s game against the Boston Breakers, a precautionary step taken after the U.S. international suffered a concussion-esque head injury last Saturday in the team?s visit to Washington, D.C. According the the club, Wambach ?is progressing each day, but will be taking the necessary steps to ensure a full, healthy recovery.??Without her, the Flash will not only need to reorganize their attack, but they?ll need to compensate for the absence of their biggest drawing card.
Wambach was hit in the head by a kicked ball late in Saturday?s visit to the Washington Spirit. Although she finished out the five minutes remaining in the match, the Flash striker was evaluated for a concussion post-game and wasn?t made available to the media. Spirit players noted Wambach was mumbling and unable to remember the time between being hit and the final whistle. Until today?s announcement, she had been considered day-to-day ahead of Saturday?s visit from Boston.

I described the scene to neurosurgeon Robert Cantu, the co-director of the Center for the Study of Traumatic Encephalopathy at Boston University and co-author of the new book Concussions and Our Kids. Cantu said it was ?absurd? that Wambach wasn?t yanked off the field ?
The National Women?s Soccer League says it?s not. A spokesman said the league follows the concussion guidelines of the U.S. Soccer Federation ? The guidelines state: ?Immediately remove athlete from participation if concussion is suspected.? It was certainly possible that Wambach could have been concussed. Did game personnel just fail to follow the guidelines?
NWSL commissioner Cheryl Bailey told me that league personnel are aware of the U.S. Soccer concussion guidelines and that they were applied in this case.
Fair enough. The author of the Slate piece disagrees, but he also hypothesized a curious motive: ?did Wambach stay in because she?s Abby ? as important as anyone to the fate of the third women?s league in the last decade??
Wambach doesn?t carry that profile anymore. Not since Alex Morgan emerged, but in her home town of Rochester, Wambach is still expected significant draw, particularly for a team that was short changed in player allocation (the Flash got two, instead of three, U.S. internationals). While most expected her to land in Portland before this winter?s dispersal, Wambach was tabbed to be the new Flash?s marquee star.
Western New York head coach Aaran Lines talked to ProSoccerTalk on Wednesday ahead of our Game of the Week feature. Here were his thoughts on Wambach?s commercial value:
Abby?s here to first and foremost play for the club and play well for the club. People should come out and support the [team] and see Abby Wambach play for the [team]. I hope we get a ton of support throughout the season ? people wanting to come out and see her play on the Western New York Flash team. There?s not only Abby. There are other good players around Abby ? very, very high level players. So I hope they come out and support the team with Abby in it.
We?ll see on Saturday. Even when Wambach was expected to play, the preliminary numbers were a little low:
